Terms of Service — FYX DESIGNS

This Terms of Service outlines the legal agreement between FYX DESIGNS (“Company”) and the customer (“Buyer”). By purchasing or using any product, Buyer agrees to the terms below.

1. Assumption of Risk

Buyer acknowledges that cycling, e-moto riding, motorcycle use, and any related modifications are inherently dangerous activities that may result in property damage, serious injury, or death.

Buyer voluntarily assumes all risks associated with:

  • Product installation

  • Product use or misuse

  • Vehicle modification

  • Operating a modified vehicle

FYX DESIGNS assumes no responsibility for injuries, damages, or losses resulting from the use of its products.

2. Product Use Disclaimer

All products sold by FYX DESIGNS are intended for off-road, recreational, or performance applications unless explicitly stated otherwise.

Buyer is responsible for:

  • Understanding product limitations

  • Ensuring correct and safe installation

  • Verifying compatibility with their specific vehicle

  • Using products only in a safe and lawful manner

3. No Warranty (As-Is Sale)

All products are sold strictly on an “AS IS” and “AS AVAILABLE” basis without warranties of any kind, express or implied.

This includes but is not limited to:

  • Fitness for a particular purpose

  • Merchantability

  • Safety or performance guarantees

  • Longevity or durability under specific conditions

4. Buyer Responsibility

Buyer agrees that they are solely responsible for:

  • Proper installation of all products

  • Use of qualified professionals when needed

  • Routine inspection and maintenance

  • Ensuring safe operating conditions after installation

FYX DESIGNS is not responsible for failures caused by improper installation, misuse, or modification.

5. Release of Liability

To the fullest extent permitted by law, Buyer agrees to release, indemnify, and hold harmless FYX DESIGNS, its owners, employees, contractors, and affiliates from any and all claims, damages, liabilities, or expenses arising from:

  • Product use or misuse

  • Improper installation

  • Mechanical failure

  • Accidents, injury, or death

  • Violation of safety instructions

  • Unauthorized modifications

6. No Legal or Regulatory Compliance Guarantee

Buyer is responsible for ensuring compliance with all applicable laws and regulations in their jurisdiction.

FYX DESIGNS does not guarantee that any product is street legal, regulation compliant, or approved for use on public roads.

7. Limitation of Liability

In no event shall FYX DESIGNS be liable for any indirect, incidental, special, or consequential damages arising from the use of its products, including but not limited to loss of use, loss of income, or property damage.

8. Order Acceptance and Right to Refuse Service

FYX DESIGNS reserves the right to cancel, refuse, or limit any order at its sole discretion, including suspected fraudulent or high-risk transactions.

9. Dispute Resolution and Chargebacks

By completing a purchase, Buyer agrees to contact FYX DESIGNS directly before initiating any chargeback or payment dispute.

FYX DESIGNS reserves the right to contest all chargebacks using:

  • Order records

  • Payment verification data

  • Shipping and delivery confirmation

  • Communication history

10. Intellectual Property

All branding, product designs, images, and content are the exclusive property of FYX DESIGNS and may not be copied, reproduced, or distributed without written permission.

11. Agreement

By purchasing, installing, or using any FYX DESIGNS product, Buyer confirms they have read, understood, and fully agreed to this Terms of Service agreement.
